CONDITIONS.

These Terms and Conditions (“Terms”) govern your use of BoomWall10K (“BoomWall”, “we”, “us” or “our”), including browsing the website, entering a Boom Week, connecting TikTok, appearing on leaderboards, nominating public content for Wall placement, purchasing paid Wall placements and using any subscription features we make available.

By entering a Boom Week, connecting an account, purchasing a service or otherwise using features that require agreement to these Terms, you agree to be bound by them.

Before commercial launch, this section will be updated with the full legal name and business details of the entity operating BoomWall10K.

Anyone may browse publicly available parts of BoomWall.

You must be at least 18 years old to enter a Boom Week, connect a social media account, purchase a Wall placement or start a paid subscription.

By entering or purchasing, you confirm that you are at least 18 years old and have legal capacity to agree to these Terms.

You may only enter BoomWall using a TikTok account that you own or control and are authorised to connect.

TikTok verification is used to help confirm account ownership and, where authorised, to obtain profile and follower information used to operate BoomWall.

You must not impersonate another creator, connect an account you do not control, submit false information or attempt to interfere with account verification.

Boom is a free weekly creator-ranking and showcase feature of BoomWall. There is no fee to enter a Boom Week.

When you enter, BoomWall records your verified or authorised TikTok follower count and assigns you to a starting follower category for that Boom Week.

Your starting follower count and starting Boom category are locked for that Boom Week and cannot be changed after entry.

You may update information we specifically allow you to manage, such as your nominated public TikTok content, contact email or content category.

Creators are assigned to one of five starting categories:

• Micro — under 1,000 followers;
• Emerging — 1,000 to under 10,000 followers;
• Rising — 10,000 to under 100,000 followers;
• Established — 100,000 to under 1,000,000 followers; and
• Major — 1,000,000 followers or more.

You remain in the category assigned when you enter for the duration of that Boom Week, even if your follower count later crosses into another category.

Rankings are based on the number of new TikTok followers gained after entry during the relevant Boom Week.

In general, follower growth is calculated as your current verified follower count minus your locked starting follower count.

Rankings may change throughout the week as follower data updates. Displayed positions are provisional until the Boom Week closes and final results are verified.

If two or more creators record the same verified follower growth during a Boom Week, the creator who entered that Boom Week earlier will be ranked higher.

The four creators with the highest verified follower growth in each starting category finish above the Boom Line and make that week's Boom 20.

The four highest-ranked creators in each starting category form that week's Boom 20 and may be featured on the Wall during the following Boom Week as part of BoomWall's weekly creator showcase.

The creator ranked first in each category may be displayed in a larger Boom tile, while creators ranked second, third and fourth may be displayed in standard Boom tiles. These display sizes reflect final category ranking and form part of the BoomWall platform feature.

BoomWall may correct an obvious ranking or calculation error before or after publication where reasonably necessary to preserve the integrity of results.

An active TikTok connection may be required for BoomWall to update follower information and verify your result.

If your connection is lost or revoked, BoomWall may pause or mark your ranking as requiring reconnection. You may be given an opportunity to reconnect before the Boom Week ends.

BoomWall will attempt to verify your follower count when the Boom Week closes. If a final verification cannot be completed, BoomWall may use your most recent successfully verified follower count recorded within the preceding 24 hours.

If no follower count has been successfully verified within that period, you will not receive a final ranking for that Boom Week.

BoomWall is designed to recognise genuine creator growth.

You must not use bots, purchased followers, automated manipulation, fraudulent methods or other artificial activity intended to manipulate BoomWall rankings.

Large or rapid follower growth is not by itself evidence of manipulation. Viral growth is allowed and encouraged.

BoomWall may investigate activity that reasonably appears artificial or fraudulent and may temporarily hold a result while relevant facts are reviewed.

BoomWall may remove or disqualify an entry where we reasonably determine that a creator has:

• used fake, purchased or manipulated followers;
• impersonated another person or creator;
• submitted false or misleading information;
• interfered with BoomWall systems or security;
• submitted unlawful, harmful or clearly inappropriate content;
• materially breached these Terms; or
• acted in a way that materially undermines the integrity of the Boom.

Where reasonably practicable, BoomWall may seek clarification before finalising a removal or disqualification decision.

You may nominate public TikTok content for potential display or promotion on BoomWall.

You may change your nominated TikTok content while the relevant Boom Week is open. Once that Boom Week closes, your nomination is locked. If you are selected as a Booming Creator, the nominated TikTok content saved at the time the Boom Week closes will be used for your Boom 20 feature on the Wall and cannot be changed during that feature period. You may nominate different TikTok content when you join a subsequent Boom Week.

You retain ownership of your content. By nominating content, you give BoomWall a limited, non-exclusive permission to display, link to, reproduce thumbnails or previews where permitted, and otherwise use that nominated public content as reasonably necessary to operate and promote the BoomWall service.

You confirm that you have the rights and permissions necessary to nominate that content and that doing so does not knowingly infringe another person's rights.

If nominated content becomes unavailable, private, deleted or otherwise inaccessible, BoomWall may ask you to choose another item.

BoomWall is a public creator-discovery platform. By entering, you understand that information such as your TikTok username, display name, profile image, follower growth, Boom category, leaderboard position, Boom 20 result and nominated public content may be displayed publicly.

Historical Boom results may remain publicly available after a Boom Week ends.

BoomWall may maintain public archives of completed Boom Weeks so creators and visitors can view past rankings and Boom 20 results.

Historical records are retained by default, but creators may contact BoomWall to request removal or anonymisation where appropriate.

BoomWall may offer optional paid Wall placements that allow creators to purchase promotional visibility without affecting leaderboard position.

The applicable price, placement size, duration and other key details will be shown before purchase.

Paid placement never increases your follower-growth score, changes your Boom category, moves you up a leaderboard or affects whether you make the Boom 20.

BoomWall may offer optional recurring subscriptions that include Wall placement or other creator benefits.

Before you subscribe, we will clearly show the subscription price, billing frequency, included benefits and that the subscription renews automatically until cancelled.

You may cancel a subscription at any time without a cancellation fee. Cancellation stops the next renewal. Unless otherwise stated or required by law, your current paid period continues until its expiry.

BoomWall will not intentionally make cancellation materially harder than starting the subscription.

If a creator with an active paid Wall placement or subscription is ranked in the Boom 20, their Boom 20 feature may temporarily replace their paid placement so that the creator does not appear twice for the same purpose.

The paid or subscription placement may resume after the Boom 20 feature ends, provided the paid service remains active.

The paid or subscription placement may resume after the earned Boom 20 placement ends, provided the paid service remains active.

Prices will be displayed in the currency stated at checkout. Where Australian pricing laws apply, BoomWall will display prices and unavoidable charges in accordance with applicable requirements.

Payments may be processed through third-party payment providers. BoomWall may receive payment status, transaction identifiers, subscription status and related billing information needed to provide the purchased service.

If a payment fails, expires, is reversed or cannot be processed, BoomWall may suspend or delay the associated paid service until payment is successfully resolved.

For one-off paid Wall placements, cancellation or refund availability may depend on whether the placement has already commenced.

Once a paid placement has gone live, BoomWall does not generally offer a change-of-mind refund for the unused portion unless we state otherwise or applicable law requires a remedy.

Subscription cancellation stops future renewal charges but does not generally create a refund for the current paid period solely because you changed your mind.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, including rights that may apply under the Australian Consumer Law.

BoomWall relies on third-party services and platforms, which may include TikTok, database providers, hosting providers, payment processors and other technology providers.

Those services operate independently and may have their own terms, privacy policies, outages, restrictions and technical limitations.

BoomWall is not responsible for third-party services to the extent permitted by law, but we will take reasonable steps to manage dependencies that materially affect the BoomWall service.

BoomWall aims to provide reliable rankings and updates, but follower data and connected-platform information may be delayed, unavailable or affected by third-party API limits or outages.

BoomWall may temporarily pause, delay or correct leaderboard updates where data cannot be reliably obtained.

We do not guarantee that BoomWall or any third-party integration will be available without interruption at all times.

BoomWall10K, the BoomWall branding, site design, graphics, software, leaderboard presentation, logos and other original platform material are owned by or licensed to BoomWall and are protected by applicable intellectual-property laws.

These Terms do not transfer ownership of BoomWall intellectual property to you.

You must not use BoomWall to:

• break applicable law;
• interfere with platform security or operation;
• scrape or access restricted data without permission;
• introduce malicious code;
• harass, threaten or target other users;
• misrepresent your identity or affiliation;
• infringe intellectual-property or privacy rights; or
• attempt to manipulate the Boom or Wall unfairly.

BoomWall may suspend or restrict access where reasonably necessary to investigate fraud, security concerns, payment issues, abuse, Terms breaches or risks to the integrity of the service.

Where appropriate, we may remove an entry, terminate access or end a paid service in accordance with these Terms and applicable law.

You may contact BoomWall to request assistance disconnecting TikTok, accessing or correcting personal information, or requesting deletion or anonymisation where applicable.

Some information may need to be retained where required or permitted by law, including appropriate transaction, fraud-prevention or dispute records.

Our collection, use, disclosure and handling of personal information is described in the BoomWall10K Privacy Policy.

By using features that involve personal information, you acknowledge that information will be handled as described in that Policy and applicable law.

Nothing in these Terms excludes, restricts or modifies any guarantee, condition, warranty, right or remedy that cannot lawfully be excluded or restricted, including rights under the Australian Consumer Law where it applies.

If BoomWall supplies a service that fails to meet a statutory consumer guarantee, you may be entitled to remedies provided by applicable law.

To the maximum extent permitted by law, BoomWall is not responsible for indirect or consequential loss arising solely from circumstances outside our reasonable control, including third-party platform outages or unavailable social-media data.

Nothing in this clause excludes or limits liability where doing so would be unlawful, including liability that cannot be excluded under applicable consumer law.

BoomWall is still developing and we may add, change, replace or remove features, categories, pricing, Wall placement options or other parts of the service.

We will not retrospectively alter a completed Boom result or paid entitlement without a reasonable basis, such as correcting an error, fraud, legal requirement or technical issue.

We may update these Terms as BoomWall develops or where required by law, technology providers or changes to our services.

The current Terms will be published on this page with the latest update date. Where required by applicable law, we will provide additional notice or seek consent before material changes take effect.

BoomWall is operated from Australia and intended for a worldwide audience.

These Terms are governed by the laws applicable to the Australian operator of BoomWall, subject to mandatory consumer, privacy and other rights that may apply in your own jurisdiction and cannot lawfully be excluded.

Before commercial launch, this section will be updated with the final Australian legal operator and applicable State or Territory.
